In consideration of any works of art purchased via this website (hereinafter “Art”), and with the understanding that the art has the potential  to cause serious injury, death, and property loss or damage, I RECOGNIZE AND AGREE TO ASSUME ALL RISKS known and unknown that arise or might arise as a result of my purchase and ownership of the Art.  On my own behalf, and on behalf my executors and administrators, next of kin, successors and assigns, RELEASE and forever discharge Richard McGehee Art, their agents, and employees, and ownership of and from any and all liabilities, claims, demands, damages, actions, costs, or expenses of any nature, known or unknown, arising out of or in any way connected with the purchase or possession of the Art.  I further agree to indemnify and hold Richard McGehee Art, their agents, and employees, and ownership against any and all liabilities, claims, demands, damages, actions, costs or expenses of any nature, including, but not limited to, all attorneys' fees and disbursements, arising out of or in any way connected with my purchase or possession of the Art. 

I understand and agree that this General Liability Release and Indemnity Agreement includes any claims based on the negligence, actions or inaction of any of the Richard McGehee Art, their agents, and employees, and ownership and covers bodily injury, death, and property damage or loss, whether suffered by me or others, as a result of my purchase or possession of the Art.  

Richard McGehee Art and I (hereinafter the “Parties”) agree that this release is intended to be broad and inclusive as permitted by the laws of the State of Florida, and that if any portion of the agreement is held to be invalid that the balance shall continue in full force and effect.  The participants further agree that Florida law controls this agreement and venue for this release shall lie in the circuit or county court in and for Nassau County or, if filed in federal court, in the Northern District of Florida.

It is mutually agreed by and between the Parties that each of the Parties do hereby waive trial by jury in any action, proceeding or claim which may be brought by either of the parties hereto against the other on any matters concerning or arising out any use of this Website or the purchase of any Art.  In any such action, each party shall be responsible for their own attorneys fees, including those incurred in appellate proceedings.
